, dsp D/DHn L3 Order in Cause Order in Cause Level: Item Dates of Creation 1715 Extent 1 vol. Scope and Content Order in Cause, Robert Atkins [executer of Edmund Waterson of Graces in Little Baddow, deceased] v. Elizabeth Waterson, widow of Edmund Waterson Recites that Edmund Waterson son of William Waterson, gent., of London, did marry Elizabeth Mildmay, daughter of Henry Mildmay of Graces in Little Baddow, and that before marriage was solemnized a settlement [August 1696, (see D/DHn T22)] to the value of £201 per aannum was made on the defendant for her jointure out of the real estate of William Waterson, although she had no possessions in money or any personal estate under the will of her father Henry Mildmay, and that Edmund Waterson died about 16 January 1714/5 without issue shortly after making his will in order to dispose of his personal estate amounting to £20,000 and more, most of which was left to him by his father, and by his will bequeathed to his wife Elizabeth £500 in money and £100 for mourning, the remainder to be laid out in the purchase of lands in Suffolk for the benefit of his sister Margaretta Bonnell and her children, and that after the death of Edmund Waterson his widow Elizabeth possessed herself of all his personal estate at Graces in Little Baddow and refused to deliver them to the plaintiff, and that Elizabeth Waterson pretended that Edmund Waterson was a freeman of London and that according to the Custom of London the widow is entitled to half her late husband's estate, and that at the time of her marriage to Edmund Waterson, Elizabeth Waterson was executrix of her father Henry Mildmay and was entitled to a personal estate of about £2,000 plus £300 per annum and that after the death of her mother Mary Mildmay was entitled to a real estate worth £250 per annum, and that although no notice was taken of her estate in the marriage settlement, her late husband Edmund Waterson raised large sums of money by felling timber on her estates, using the timber for repairing his own estate and that he received the rents and profits of her estate until his death.
