WALLIS Elizabeth Effects under 9,000
4 February [1858] The Will with a Codicil of Elizabeth Wallis late of
Bootham in the City of York Spinster deceased who died 4 June 1857 at
Bootham aforesaid was proved at York by the oaths of George Beevor
Lambert of North Ferriby near Kingston upon Hull in the said county
Wine Merchant and the Reverand Edward Prest of Sherburn Hospital in
the County of Durham Clerk the executors.

On the fourth day of February 1858 the will with one codicil thereto
of Elizabeth Wallis late of Bootham in the City of York spinster
deceased who died on the fourth day of June 1857, at Bootham aforesaid
was proved in the District Registry attached to Her Majesty's Court of
Probate at York, by the oath of George Beevor Lambert of North Ferriby
near Kingston upon Hull in the County of York wine merchant and the
Reverend Edward Prest of Sherburn Hospital in the County of Durham
clerk the joint Executors therein named they having been first sworn
to administer

Effects under 9,000-

This is the last will and testament of me Elizabeth Wallis of the City
of York spinster made this twenty seventh day of June in the year of
our Lord one thousand eight hundred and fifty four I give and bequeath
all my household effects furniture books linen and china subject as to
the furniture to the provisions hereinafter contained to my four
nieces Eleanor Anne Huntingdon Arabella Prest Elizabeth Clare Hall and
Emma Wallis the daughters of my sister Mary Ann Lambert in equal
shares and proportions And I declare that the share therein of the
said Eleanor Anne Huntingdon shall be for her sole and separate use
and all my real estate and the residue of my personal estate
whatsoever and wheresoever I give and devise and bequeath unto George
Beevor Lambert of North Ferriby near Kingston upon Hill wine merchant
and the Reverend Edward Prest of Sherburn Hospital their heirs
executors adminsitrators and assigns Upon trust that they my said
trustees and the survivor of them and the heirs executors
administrators or assigns of such survivor do and shall with all
convenient speed after my decease sell dispose of and convert into
money so much thereof as shall be in its nature saleable and collect
get in and receive the residue thereof and do and shall stand
possessed of the monies to arise and be produced by such sale or
sales. Upon the trusts hereinafter declared concerning the name that
is to say upon trust after payment of my just debts and my funeral and
testamentary expenses to pay unto my nephew John Edward Wallis the son
of my brother Edward Wallis the sum of one thousand pounds to my
nephew Charles Richard Lambert the son of my sister Mary Ann Lambert
the sum of one thousand pounds to my nephews George Beevor Lambert and
Percival Lambert the sons of the said Mary Ann Lambert the sum of five
hundred pounds each and to my nephew Edward Lambert son of the said
Mary Ann Lambert the sum of two hundred pounds And upon further trust
to invest the sum of six hundred pounds in their joint names on seal
or government securities in England or Wales and from to time to alter
vary and transpose the same for or into other stocks funds or
securities of the like nature and to stand possessed thereof Upon
trust to pay the income dividends and annual proceeds thereof into the
proper hands of my said niece Eleanor Anne Huntingdon the eldest
daughter of my sister Mary Ann Lambert for and during her life so that
the same may be for her sole and separate use and benefit And I
declare that the receipt or receipts of the said Eleanor Anne
Huntingdon for the said interest and dividends or for the principal
moies or any part thereof which may be paid to her by virte of the
proviso hereinafter contained or for any other sum of money of share
which she shall take under this my will shall whether she shall be
covered or sole be an effectual discharge for the money or share

therein to be acknowledged to be received And from and after the
decease of the said Eleanor Anne Huntingdon in case the said principal
sum shall not have been previously paid to her upon trust to pay and
apply the said principal sum of six hundred pounds and the interest
dividends and annual proceeds thereof to such person or persons and in
such manner as the said Eleanor Anne Huntingdon by any deed or deeds
instrumnent or instruiments in writing to be by her duly executed or
by her last will and testament in writing or any codicil thereto and
whether covert or sole shall direct or appiint and in default of such
direction or appointment or so far as the same if incomplete shall not
extend Upon trust for all and every the child or children of the said
Eleanor Anne Huntingdon who shall be living at the time of her decease
in equal shares and proportions and if there shall be only one such
child then for such only child But if any of the children of the said
Eleanor Anne Huntingdon shall have departed this life leaving lawful
issue then such issue shall stand in the place of his her or their
parent or parents and shall take the share or shares which such parent
or parents would have been entitled to if living But in case there
shall be no child of the said Eleanor Anne Huntingdon living at the
time of her decease then Upon trust for the executors or
administrators of the said Eleanor Anne Huntingdon to be dealt with
and administered by them as part of her personal estate Provided
always and I hereby expressly declare it to be my will that if the
said Eleanor Anne Huntingdon shall have occasion for the said
principal sum of six hundred pounds or any part thereof during her
life and shall by any writing under her hand require my said trustees
or trustee for the time being to pay the same or any part or parts
thereof to her then I authorise and direct my said trustees or trustee
to pay the same to her accordingly And I declare that the receipt or
receipts notwithstanding coverture shall be in and effectual discharge
for the same And upon further trust to pay the legacy or sum og six
hundred pounds to each of my nieces the said Arabella Prest Elizabeth
Clare Hall and Emma Wallis the sum of five hundred pounds To my niece
Sophia Wallis the daughter of my brother Edward Wallis and the sum of
three hundred pounds to my niece Clare Dodsworth daughter of the said
Edward Wallis and upon further trust to pay the sum of one hundred
pounds each to John Wallis Lambert to pay the sum of three hundred
pounds to my goddaughter Lucy Lambert the daughter of the said John
Wallis Lambert and the sum of fifty pounds to William Prest the son of
the late John Prest And upon further trust to pay the sum of thirty
pounds to my servant Mary Hudson in case she shall be living with me
at the time of my decease and also give to teh said Mary Hudson if she
be

living with me sufficient furniture to furnish a bed room the same to
be selected at the discretion of my said trustees And I declare that
this selection thereof shall be conclusive any provision hereinbefore
confirmed to the contrary in anywise notwithstanding And as to all the
rest residue and remainder of my estate and effects whatsoever after
deducting thereout the two several legacies hereinafter bequeathed
Upon trust for my said nieces Eleanor Anne Huntingdon Arabella Prest
Elizabeth Clare Hall and Emma Wallis in equal shares and proportions
Provided always and I do hereby declare that in case any of the
legatees named in this my will shall not be living at the time of my
decease but shall have departed this life leaving lawful issue him her
or their surviving and who shall be living at the time of my decease
then such issue shall stand in the place of his her or their parent or
respective parents so dying and shall take the share or shares which
such parent or parents would have been entitled to if living in equal
shares and proportions I give and devise all such estates as are
vested in me upon any trust or by way of mortgage unto the said George
Beevor Lambert and Edward Prest their heirs executors administrators
and assigns. To hold and dispose thereof upon the trusts or equities
affecting the same And lastly I nominate and appoint the said George
Beevor Lambert and Edward Prest to be executors in trust of this my
will And I give and bequeath unto each of them the legacy or sum of
fifty pounds as an acknowledgement for the trouble they will have in
the execution of the trusts hereof Provided always and I do hereby
declare that the receipt or receipts of the trustees or trustee for
the time being of this my will for any money payable to them by virtue
of the trusts hereof shall effectually discharge the person or persons
paying the same from being ansdwerable oir accountable for the
application misapplication or nonapplication of the money therein
acknowledged to be received Provided also and I do hereby declare that
if the trustees appointed in this my will or to be appinted as
hereinafter mentioned or any of them or their or any of their heirs
executors administrators or assigns shall happen to die or be desirous
of being discharged from or refuse decline or become incapable to act
in the trusts hereby in them respectively reposed then and in such
case and when and so often as the same shall happen it shall and may
be lawful to and for the then surviving or continuing trustees or
trustee or the executors or administrators of the last surviving or
continuing trsutee by any deed or deeds instrument or instruments in
writing duly executed from time to time to nominate substitute or
appoint any person or persons to be a trustee or trustees in the stead
or place of the trustee or trustees so dying or desiring to be
discharged or refusing declining or becoming incapable to act as
aforesaid and the person or persons so to be appointed as aforesaid
shall so soon as the trust property shall have been vested in him or
them soley or jointly with the


surviving or continuing trustees or trustee have all the powers and
authorities of the trustee or trustees in whose room he or they shall
be substituted Provided always and I do hereby declare that the
several trustees hereby appoiunted and to be appointed and each and
every of them and the heirs executors adminsitrators and assigns of
them and each and every oif trhem shall be charged and chargeable
respectively for such monies only as they respectively shall actually
receive and shall not be answerable or accouynatble for the others or
other of them or for involuntary losses anbd also that it shall and
may be lawful for them with and out of teh monies which shall come to
their respective hands by virture og th trusts aforesaid to retaixxx
to an reimburse themselves repsectively and also to allo their
respective cotrustee or cotrustees all costs charges damages anbd
expenses which they or any of them shall or may suffer sustain or be
put into on or about the execution of the aforesaid trusts or in
relation thereto IOn witness whereof I trhe said Elizabeth Wallis the
testatrix have to the four preceeding sheets of this my last will and
testament and also to this fifth and last sheet thereof set my hand
the dau andyear first herein written

hert presence and in the presence of each other have subscribed our

Whereas I Elizbeth Wallis of the cioty of York spinster have duly made
and executed my last will and testament in writing bearinf date the
twenty sevneth dauy of June iun the year of our Lord one thousand
eight hundred and fifft four Now I do hereby declare this to be a
codicil to my said will And I direct the same to be annexed thereto
and taken as part thereof I give and bequeath tpo my niece Clare
Dodsworth tyhe legacy o sum of two hundred pounds in addition to the
legacy given to her in and by my said will and to Edward Lambert the
son of my sister Ann Lambert teh legacy or sum of one hundred pounds
in addition to t5he legacy given to him in and by the said will and to
my servant Mary hudsoin the legacy or sum of twenty pounds in addition
to what I have given her in and by my said will And I also give a
bequeath to my ftiend ElziabetH Jackson the legacy or sum of nineteen
guineas and to my servant Mary Digney the legacy or sum of ten pounds
And I do hereby ratify and confirm my said will in witness where of I
the said Elizabeth Wallis the testarix have to thsi codicil to my last
will and ytestament set my hand the second day of June in the year of
our Lord one thousand eight hundred and fifty seven Elizabeth Wallis
Signed made and acknowledfed by t5he said Elizabeth Wallis the
testatric asd and for a codicil to her last will and testament in teh
rpesence of us present at trhe same time who at her request in her
presence and in teh rpesence of each other have subsctibed our names
